July 2023 REAR END COLLISION SETTLEMENT $828,828.70
In September of 2021 the Plaintiffs, a husband and his wife and two minor children, were in their minivan on their way to a middle school soccer game when they were rear ended by a package delivery van owned by San Jose based Ferocious, LLC. The Plaintiffs’ minivan sufferedsubstantial damage and was pushed into the vehicle in front by the impact. Plaintiff husband (the driver) suffered neck and back injuries that resulted in cervical disc surgery and a lumbar epidural injection for pain. A prior auto accident causing a compression fracture of the neck more than a decade previous to this accident required an apportionment of Plaintiff husband’s damages attributable to this accident versus the prior injury. The other members of the Plaintiff’s family suffered minor injuries.
STASKUS LAW FIRM, P.C., by Kim David Staskus, Esq., obtained a global settlement of $828,828.70, which represented all remaining available insurance proceeds in the case after defendant’s settlement with the party operating the vehicle in front of the Plaintiffs.
